Indictments lor murder. Before Judge Mitchell. Lowndes superior court. September 9, 11, 1905. Milton, Jesse, Leonard, and J. G. Rawlins were arrested for the offense of murder, and were committed to jail. A special term of the court was called for the disposition of their cases. When the grand jury was organized, and before any indictment was preferred-, each of the accused filed a written challenge to the array, upon the ground that the grand jury was not legally organized.

1. The constitution declares that “The General Assembly shall provide by law for the selection of the most experienced, intelligent, and upright men to serve as grand jurors, and intelligent and upright men to serve as traverse j urors. Nevertheless, the grand jurors shall be competent to serve as traverse jurors.” Civil Code, §5877; Penal Code, §851. The General Assembly has provided that the selection of jurors shall be made by a board of jury commissioners composed of six discreet persons appointed by the judge of the superior court in each county.
