The defendant was tried upon an indictment charging him with murder, and the jury found him guilty of voluntary manslaughter. The court overruled a motion by him for a new trial, and sentenced him to confinement in the penitentiary for the term of nine years. To the order overruling the motion for a new trial and to entering judgment on the verdict the appellant excepted and assigns the same as error.
