Appeal from the District Court of the State of Nevada, Elko County. R. R. Bigelow, District Judge. The facts are sufficiently stated in the opinion. I. The court erred in refusing to allow defendant’s witness, Anna Bates, to testify to a certain conversation had with defendant during his confinement in the county jail. Appellant was convicted of murder in the second degree for the killing of George Piccoli, and was sentenced to the penitentiary for the term of his natural life. Upon the trial he relied upon two separate and distinct defenses: (1) Self-defense; (2) Insanity. The various questions presented for our determination relate solely to the ' plea of insanity.
