Appeal from a judgment of the superior court for Thurston county, Linn, J., entered June 12, 1903, upon a trial and conviction of the crime of murder, in the first degree.

Appellant was convicted of the crime of murder in the first degree, and sentenced to death. From this judgment he appeals.
The facts are briefly as follows: On January 20, 1903, the appellant, Charles Clark, and Leila Page were living together in a house of prostitution in the city of Olympia. Leila Page was the mistress of the house. They, had been so living for about a year. On the date named appellant and Leila Page, at about 4:30 o’clock in the morning, retired to their bedroom.
