HEADNOTES ARE NOT AN OFFICIAL PRODUCT OF THE COURT, THEREFORE THEY ARE NOT DISPLAYED.] On the trial the people endeavored to show that the killing was manslaughter in the third degree; and the prisoner, that the killing was in self-defence, and thus justifiable homicide. The court charged the jury that the prisoner was bound to prove his defence of justifiable homicide "beyond a reasonable doubt." In this I think the court erred.
