McKEAGUE, Circuit Judge.
Case Western Reserve University suspended sophomore student Olaoluwa Fa-parusi after it found he had violated the school’s code of conduct by entering a women’s restroom and taking photos under the stall walls. Believing the disciplinary procedures employed by the school to be constitutionally insufficient and in breach of the school handbook, Faparusi brought suit alleging Fourteenth Amendment due process violations and a state law breach of contract claim.
