Plaintiff-Appellant Kathryn Keys filed a class-action lawsuit against her former employer Defendant-Appellee Humana, Inc., alleging claims of race discrimination under the Civil Rights Act of 1991, 42 U.S.C. § 1981, and Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. The district court granted Humana’s Motion to Dismiss Keys’s Amended Complaint after finding that Keys failed to plead a prima facie case of race discrimination under the burden-shifting framework of McDonnell Douglas.
