The plaintiff and defendant in this action, with another, became cosureties upon an indemnity bond given by one Bobinson to the Montana Oil Company. Bobinson defaulted in the fulfillment of the obligation for the faithful performance of which the bond was given, whereupon the company commenced an action upon the bond, making Bobinson and his sureties parties defendant, and in the action eventually judgment was rendered in favor of the company and against the plaintiff in this action.
