MEMORANDUM

DuBOIS, District Judge.

I. INTRODUCTION

Petitioner, Essam Khalifa Beshli (“petitioner”), a thirty-seven year-old native and citizen of Egypt, is subject to a final order of removal issued under 8 U.S.C. § 1228(b). The final order of removal arises from an October 4, 2001 conviction for conspiracy to traffic in and use unauthorized access devices, in violation of 18 U.S.C. § 1029(b)(2) and (c)(1)(A), in the United States District Court for the Eastern District of New York.
