I. INTRODUCTION

This is a breach of contract action arising out of the construction of a new terminal and renovation of the adjacent terminal at the Philadelphia International Airport. In July 2002, plaintiff LBL Skysystems (USA), Inc. (“LBL”), a contractor, sued one of its subcontractors, defendant APG-Ameriea, Inc. (“APG”) for breach of contract. Also named as a defendant was APG’s surety, Sentry Select Insurance Company (“Sentry”).
