DECISION AND ORDER

RANDA, District Judge.

This matter comes before the Court on a variety of motions, both dispositive and non-dispositive. The case involves the alleged failure of a mechanical conveyor purchased by Rich Products Corporation (“RPC”) from Kemutec, Inc. (“Kemutec”). The Court’s decision sets forth the disputed and undisputed facts developed to date and resolves each motion based on those facts.
