MEMORANDUM OPINION AND ORDER DENYING MOTION FOR SUMMARY JUDGMENT

ERICKSON, District Judge.

Before the Court is Defendant’s Motion for Summary Judgment (doc. # 21). Plaintiff filed a brief in opposition (doc. #27).
