APPEAL from a judgment of the Superior Court of San Joaquin County and from an order denying a new trial. C. W. Norton, Judge. The facts are stated in the opinion of the court.

The defendant was convicted of the crime of obtaining from one Bert Romeroni and one James Vernon, on or about the second day of January, 1911, the sum of one hundred and fifty dollars by false and fraudulent pretenses. He appeals both from the judgment and the order denying a new trial.
The attack upon the judgment and the order is based upon the asserted insufficiency of the evidence to justify the verdict of conviction, and certain rulings of the court admitting and rejecting certain evidence.
