MEMORANDUM OPINION

BULLOCK, District Judge.

On January 24, 2003, Jeffrey Gottesman (“Plaintiff’) filed an employment discrimination suit against J.H. Batten, Inc. (“Defendant”). Plaintiffs complaint alleges several bases for relief in five separate counts: (1) age discrimination in employment in violation of the Age Discrimination in Employment Act, 29 U.S.C. § 621 et seq.
