FERGUSON, Judge:

Arraigned and tried before a general court-martial convened by the Commanding General, 4th Armored Division, the accused was found guilty of assault upon a superior commissioned officer, who was then in the execution of his office, and assault consummated by a battery upon a Sergeant Cook, in violation, respectively, of Uniform Code of Military Justice, Articles 90 and 128, 10 USC §§ 890, 928. He was sentenced to dishonorable discharge, forfeiture of all pay and allowances, confinement at hard labor for three years, and reduction to the lowest enlisted…
