Kilday, Judge:

A general court-martial convened at the Marine Corps Air Station, Cherry Point, North Carolina, found the accused guilty of assault and battery upon his wife and of conduct to the discredit of the armed forces, in violation of Articles 128 and 134, respectively, Uniform Code of Military Justice, 10 USC §§ 928 and 934. The conviction and *306sentence, which includes a bad-conduct discharge, were affirmed on intermediate appellate review. We granted the accused’s petition for further review.
