Statement of the case.—Sometime prior to May 14, 1908, the City Council of Amarillo granted to H. H. Davenport & Company, a firm composed of H. H. Davenport and W. W. Taylor, a franchise to install and operate a telephone system in the city of Amarillo, and that company purchased a lot and partly constructed a building thereon to be used in connection with .their telephone system.
