This is a first degree murder case in which the jury did not recommend mercy. The plaintiff in error, James D. Lyon, was jointly indicted with his brother, Leonard Lyon, by the grand jury of Huron county, for the killing of Frank E. McG-rath. The indictment contained three counts. The first count charged that the killing was willful, malicious, and premeditated. The second count charged that the killing took place while the Lyon brothers were engaged in the committing of a robbery.
