Home Savings Bank v. Kelley

This action is' brought upon a promissory note, executed by appellant on March 30, 1925. The note bears the indorsement of one P. J. McCarthy. Appellant filed an answer, anci thereafter filed a motion for an order that the indorser, McCarthy, be brought into said case as a Party, and that the proceedings be stayed until he was brought in. Appellee filed a demurrer to appellant’s answer. The court overruled the motion to bring in the indorser, whereupon the appellant prosecuted an appeal from said order.
