Gary Hobbs (“Plaintiff’), a citizen of Virginia, brought an action in diversity against Sean St. Martin (“Defendant”), a citizen of Maryland, alleging that Defendant wrongfully received and retained $500,000 that Plaintiff loaned to one Richard Hagen, a nonparty. Plaintiff brought claims for Money Had and Received (Count I), Unjust Enrichment (Count II), and Conversion (Count III).
