MR. JUSTICE PLUMMER Delivered the Opinion of the Court.

The defendant was tried and convicted upon an information charging the crime of rape alleged to have been committed upon the person of a girl of the age of thirteen years and was sentenced to serve one year in the county jail. Prom the judgment of conviction and the denial of his motion for a new trial the defendant appeals.
