On September 28, 1944, the District Attorney of Los Angeles County, filed a second amended information containing six counts, the first three counts of which charged defendant with the commission on April 11, 1944, of the offenses of kidnapping, rape, and assault by means of force likely to produce great bodily injury upon Mrs. Marion Davis. Counts 4 and 5 charged kidnapping and assault by means of force likely to produce great bodily injury committed by defendant on May 15, 1944, against Helen Rogers.
