The case is before the Court on cross-motions for summary judgment by Plaintiffs and the FDIC.

1. Plaintiff Texas American Bancshares, Inc. (“TAB Holding”) is a bank holding company registered under the Bank Holding Company Act of 1956, 12 U.S.C. §§ 1841 et seq.
