MEMORANDUM AND ORDER

Plaintiffs bring this action pursuant to the Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§ 1346(b) & 2671-2680, and the Administrative Procedure Act (“APA”), 5 U.S.C. § 701 et seq., seeking to recover $820 million in damages arising out of the government’s allegedly negligent management and operation of Franklin Savings Association. The case comes before the court on defendants’ motion to dismiss (Doc. 59) 1 plaintiffs’ second amended complaint pursuant to Fed. R.Civ.P. 12(b)(1) and 12(b)(6).
