Defendant appeals from the order denying its motion in the alternative for judgment notwithstanding the verdict or a new trial.
In the afternoon of October 12, 1924, plaintiff boarded a box car in a freight train of defendant at its yard two miles east of Crookston. The train was east bound for Cass Lake, this state. There is nothing in the pleadings or proof to show that it was other than an intrastate train.
