This action was commenced in the superior court of Muskogee county to recover a portion of the lands allotted to plaintiff in error as a citizen o# the Creek nation and to quiet plaintiff’, title thereto. Upon the trial of the casv judgment was rendered for the defendant in error, from which judgment this appea. has been prosecuted. The parties will here inafter be referred to as plaintiff and defendants, as they appeared in the trial court.

The plaintiff alleges that the court erred in refusing to grant her a jury trial. An examination of the record fails to disclose that a jury was demanded.…
