This case is the latest episode in a legal battle which has been in progress for over eleven years. After related proceedings in Indiana state court, the Federal Maritime Commission, and the United States Court of Appeals for the District of Columbia Circuit, the complaint in this action was filed in the United States District Court for the Northern District of Indiana.
