ORDER

CANCIO, Chief Judge.

This cause came to be heard on motion of co-defendant GREAT AMERICAN INSURANCE COMPANY to dismiss the amended complaint herein. Co-defendant requested and was granted leave to submit its motion by memorandum rather than by oral argument. Plaintiff was granted ten days to reply.
