I. INTRODUCTION
On June 8, 1998, plaintiff Raymond J. Hotaling (“Hotaling”) commenced the instant action against defendant New York State Police Trooper John E. LaPlante (“Tpr.LaPlante”), pursuant to 42 U.S.C. §§ 1983, 1985, 1 and 1988, alleging that the defendant violated his rights under the Fourth, Fifth, Eighth, and Fourteenth Amendments to the United States Constitution.
