THIS MATTER came before the Court during a hearing on June 22, 2009, on two related matters. The first is a review, pursuant to the Administrative Procedure Act, of the Interior Board of Land Appeals’ order of July 15, 2008 in which it upheld the Bureau of Land Management’s decision declaring Plaintiffs’ unpatented mining claims void and forfeited. The second matter is Defendants’ Motion to Strike Exhibits Attached to Plaintiffs’ Opening Brief [doc. # 14], filed November 17, 2008, to which Plaintiffs responded on December 8, 2008.
