This is an appeal perfected by appellant from a judgment for $25,000, recovered by appellee as the result of a trial by jury, in which the cause was submitted upon special issues. Appellee, in his petition, alleged that on October 20, 1922, he was in the employment .of appellant as a locomotive fireman, and on said date was working on an engine sent out by appellant from San Antonio to Nueces gravel pit in Uvalde county, that the trip there and return to San Antonio was made on that date, and that the said locomotive engine was in such defective condition that it jumped, jolted, and jerked in…
