This was a suit for personal injuries alleged to have been received by appellee while in appellant’s service as a member of its bridge and building crew, while engaged in moving along the track a push car loaded with cross-ties. Appellant alleged that while so engaged he stepped on the end of a cross-tie that was apparently sound but so rotten and defective that it broke under his weight, which caused him to fall and in some way his right foot was thrown on the rail and run over by the wheel of the car.
