Plaintiff filed a bill for specific performance of an oral agreement claimed to have been entered into between James Duncan, the deceased, and himself.
James Duncan during his lifetime was a resident of Clare, Michigan. Pie owned considerable business property in Clare and also a 360-acre farm in Isabella county, Michigan. His wife died in 1928 and he never remarried, nor did he have any children.
