HILL, Circuit Judge.
This case was brought under the Federal Employers’ Liability Act, 45 U.S.C. § 51 et seq., for damages suffered by Taylor, a railroad employee, in a railroading accident. The facts are not critical on appeal inasmuch as the trial court directed a verdict against the Railroad on the issues of negligence and contributory negligence, and no appeal is taken from those rulings.
