OPINION
COLE, Circuit Judge.
This case centers around the recent amendments to the Immigration Naturalization Act (INA), codified at 8 U.S.C. § 1182, et seq., that resulted from the enactment of the Antiterrorism and Effective Death Penalty Act (AEDPA) and the Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA). Specifically, the government appeals the district court’s decision that it retained jurisdiction pursuant to 28 U.S.C. § 2241 to review a deportable alien’s statutory claim that he was eligible for a waiver of deportation under INA § 212(c).
