OPINION

CONTRERAS, Judge.

This is a special action review of an Arizona Industrial Commission award for permanent partial disability based upon respondent employee’s (claimant’s) current employment. The issue presented for review is whether the Administrative Law Judge erroneously excluded a labor consultant’s opinion that claimant’s date of injury employment as an administrative sergeant for petitioner employer Arizona Department of Public Safety (DPS) was suitable and would have been available to him except for a post-injury termination for misconduct.
