This action is before the court on the plaintiff’s motion to remand the case to the Superior Court of Fulton County, Georgia. The case originally was brought in the Superior Court of Fulton County on May 1, 1986 against National Union Fire Insurance Company, McKenzie Tank Lines, and Elbert LeSueur Grier. The defendants are the insurer, owner, and driver, respectively, of a tractor-trailer truck involved in a collision in Mitchell County, Georgia that resulted in the death of the plaintiff’s young child.
