An application for increase in alimony for the support of a minor child was filed in DeKalb Superior Court, December 15, 1952, against John R. Meeks Jr., based on an agreement of the parties in a divorce action pending in 1946, which was then made a part of the judgment of the court, and provided that “the court shall retain jurisdiction of this case for the purpose of adjusting the amount of the payment to be made hereunder in the event of any material change in the earning capacity of the party of the first part.” A motion to dismiss the petition, for want of jurisdiction…
