LIVELY, Circuit Judge.
This is an appeal from summary judgment for the employer in an action by a former employee claiming that he was terminated solely because of age in violation of the Age Discrimination in Employment Act, 29 U.S.C. § 621 et seq. (1976). In granting summary judgment the district court concluded that the employer had es-tablished age as a bona fide occupational qualification (BFOQ) as a matter of law.
