Appellant, Elder, a retail merchant. of Lebanon, Kentucky, instituted this action in the Marion circuit court against the Florsheim Shoe Company, ■ incorporated, wholesale shoe dealers of Chicago, to recover damages for breach of contract arising out of the refusal of the shoe company to ship and deliver to appellant, Elder, at Lebanon, two or more quantities of shoes ordered by him from the company through its salesman, in February and May, respectively, 1919.
