MEMORANDUM OPINION AND ORDER
REVERCOMB, District Judge.
This is an action for trespass, originally filed in the Superior Court for the District of Columbia and removed to this Court by defendant Washington Metropolitan Area Transit Authority (“WMATÁ”). Jurisdiction rests on the WMATA Compact) D.C.Code § 1-2440 (codifying Act of Nov. 6, 1966, Pub.L. No. 89-774, § 4, 80 Stat. 1324, 1353).
