*1001In an action to recover damages for personal injuries, the plaintiff appeals from so much of an order of the Supreme Court, Kings County (Solomon, J.), entered August 29, 2005, as granted that branch of the defendant City of New York’s cross motion which was for summary judgment dismissing the complaint insofar as asserted against it.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, that branch of the cross motion of the defendant City of New York which was for summary judgment dismissing the complaint insofar as asserted against it is denied, and the…
