This action was brought by Omer Baker and wife in the district court of Deaf Smith County against the City of Hereford and E. B. Black for conversion of personal property of the alleged value of $3,795.25. At the time of the alleged conversion Black was mayor of the City of Hereford, but he was sued in his individual capacity.
