The defendant in this action, in company with
one Dr. Batterton, is a practicing physician and surgeon in the town of Colton. On the 26th day of March the plaintiff, a farmer living in the vicinity of Colton, suffered a fracture of the bones of his left leg between the knee and the ankle. A telephone message was sent to the office of said physicians requesting the defendant to come immediately and attend to the said' injury.
