*913FOSHEIM, Justice.
Plaintiff appeals from a judgment n.o.v. in favor of the defendant on a cause of action for legal malpractice. We affirm that judgment. We dismiss the cross-appeal of the defendant.
The plaintiff is a well-driller. He encountered difficulties collecting for two-wells which he had guaranteed would produce clear water. Early in 1971 the plaintiff employed the defendant to foreclose his mechanic’s liens on these accounts.
