PHILLIPS, Circuit Judge:
The United Food and Commercial Workers, Local 400 (the Union) appeals from an order of the United States District Court for the Western District of Virginia denying its application for an award of attorney’s fees. The Union requested the award on the grounds that Marval Poultry Company, Inc. (Marval) had challenged two arbitration awards in federal courts without justification.
