This case comes before the Court on Defendant’s Motion to Dismiss Pursuant to Fed.R.CivJP. 12(b)(6) [ECF No. 16]. The Court has jurisdiction over this action under 28 U.S.C. § 1331 and 28 U.S.C. § 3732(a). The motion became ripe for review on April 10, 2014 upon the filing of Defendant’s Reply [ECF No. 23]. For the following reasons, the motion is granted.
