This was an action to recover damages for injuries sustained by a passenger through the falling of an elevator in a department store. Defendant’s demurrer to the plaintiff’s evidence was sustained and she appeals.

Briefly stated, the petition charged that on October 14, 1939, the Allen W. Hinkel Company operated a store in Wichita, Kan., composed of several stories, and for the purpose of conveying customers from floor to floor, two elevators were used, and that on and before the above mentioned date the defendant Otis Elevator Company and…
