The defendant, a licensed physician, was prosecuted upon an information charging manslaughter in the second degree by causing the death of Plazel Williamson, a pregnant woman, by using an instrument with intent to destroy the' child, without such operation being necessary or advised by two physicians to be necessary to preserve the life of said Hazel Williamson.
