MEMORANDUM ORDER AND OPINION DENYING DEFENDANT’S MOTION TO DISMISS AND GRANTING PLAINTIFF’S MOTION TO AMEND COMPLAINT

ROBINSON, District Judge.

This matter comes before the Court on Defendant Shawnee County Board of Com*663missioners’ (“the County”) Motion to Dismiss For Failure to State a Claim (Doc. 153). Plaintiff Bernard Stewart has responded and has also filed a Motion to Amend Complaint (Doc. 159), to which the County objects. For the reasons set forth below, the Court denies the County’s motion to dismiss and grants plaintiffs motion to amend complaint.
